Yes, Texas dispensaries are legal, but only for medical use under the Texas Compassionate Use Program. These Texas dispensaries operate as licensed dispensing organizations authorized by state law and regulated by the Department of Public Safety (DPS). Recent legislation has expanded access to cannabis for patients living with over 150 qualifying conditions like chronic pain, PTSD, neuropathy, Crohn’s disease and more.
Texas marijuana dispensaries sell products for medical use, with a strong focus on quality, consistency and purity. Smoking cannabis remains illegal in Texas, and all products are designed for approved medical use.
Texas does not issue physical medical marijuana cards. Instead, eligible patients receive a medical cannabis prescription from a qualified physician who is registered with the Texas Compassionate Use Program. That prescription is entered into the state’s confidential Compassionate Use Registry, which licensed Texas medical marijuana dispensary staff verify at the time of access. Patient information in the registry is private and may be accessed only by the DPS, registered physicians and licensed dispensaries. This system replaces traditional medical marijuana cards used in other states.
