Medical Cannabis in Texas: What Patients Should Know

Medical marijuana is legal in Texas through the Texas Compassionate Use Program (TCUP). The program allows registered patients with qualifying medical conditions to obtain cannabis products from licensed dispensaries across the state.

Unlike many other states, Texas does not operate a traditional medical marijuana card system. Instead of receiving a physical medical marijuana card, patients are registered electronically by their prescribing physician through the Compassionate Use Registry of Texas (CURT). This registration functions as the patient’s authorization to obtain medical cannabis.

Information within the CURT regarding patient identification, including the fact that a person is listed as a patient in the registry, is confidential and may only be accessed by the department, registered physicians and licensed medical dispensaries.

It’s important to understand that recreational cannabis remains illegal in Texas. Medical cannabis access is strictly regulated to prioritize public safety while providing a controlled pathway for medical use.

Who Qualifies for a Texas Medical Marijuana Card?

To qualify for a medical marijuana card in Texas, patients must meet a few requirements established by the state’s Compassionate Use Program.

Basic Eligibility Requirements

Patients must:

  • Be a Texas resident
  • Have a qualifying medical condition
  • Be evaluated by a qualified physician and have their prescription entered into the Compassionate Use Registry.

Patients under 18 may qualify with a legal guardian's involvement, who must also be registered in the CURT system. See more information here

A physician will review the patient’s medical history and current symptoms before determining whether medical cannabis is appropriate as part of a treatment plan.

How to Apply for a Texas Medical Card Online

Obtaining a Texas medical card is a physician-guided process that can be completed in a few simple steps.

Step 1: Schedule a Telemedicine Appointment

Many patients begin by scheduling a telemedicine appointment with a physician registered in the Texas Compassionate Use Program.

Telemedicine allows eligible patients to consult with a licensed physician remotely from anywhere in the state.

Step 2: Medical Evaluation and History Review

During the appointment, the physician will review the patient’s medical history, current symptoms and prior treatments. This evaluation helps determine whether the patient qualifies and whether medical cannabis may be appropriate.

Step 3: Receive a Medical Cannabis Prescription

If the physician determines the patient is eligible, they will prescribe medical marijuana by entering the prescription into the Compassionate Use Registry of Texas (CURT), a private and secure registry only accessible to licensed dispensaries, registered physicians, the Department of Public Safety (DPS) and law enforcement. The physician may also establish a treatment plan that includes dosage guidance and product recommendations.

Step 4: Place an Order

Once a prescription has been registered, the patient is considered an authorized medical marijuana patient under Texas law. Patients can place their first order online or by calling 512-614-0343.
